Hyperliquid paid for a public good — the amicus brief as a regulatory moat

Reported (2026-09): Hyperliquid's Policy Center filed an amicus brief — via former US Solicitor General Elizabeth Prelogar (Cooley) — backing the CFTC against CME's suit over perpetual futures. Every perps venue benefits if CME loses, but only Hyperliquid paid. The bet: being the named party in the room when the rules get written is a moat that never shows up in a fee table. Not a build — a strategy pattern to recognize. A legal outcome that helps a whole class (all perps venues) is a public good; the free-rider problem says nobody funds it. Someone funding it anyway is buying something other than the shared ruling. Separate the three things the payer gets that free-riders do not — shaping the record, standing with the rule-writing agency, recognition as a serious counterparty — from the ruling itself. Then apply the counter: regulator-recognition and user-recognition are different assets, and a favorable ruling helps the cheapest venue as much as the loudest. Why

The transferable idea is the free-rider inversion. Normally a public good goes unfunded because everyone waits for someone else; here someone funds it anyway, which only makes sense if the private return — not the shared ruling — beats the bill. That private return is regulatory-pioneer status: your name on the record, on the agency's side of a live case, as a serious counterparty a US compliance desk can point to instead of 'an offshore venue with a website.' Kalshi filed to list $HYPE perps, and its Bitcoin perp is the contract CME is suing over — so one ruling governs both whether a US venue can list on Hyperliquid's token and whether Hyperliquid can operate onshore. The brief protects the road it intends to drive on.
